Licensing Agreement for Non-Commercial use by

Public Service Agency/Group or Involved Individual(s)

This is a basic license to allow for limited Non-Commercial Personal Use of photo(s) &/or video from a training, event or incident for any Group* or Involved Individual* that was directly or indirectly involved with the event.

License applies to -

  • Any Public, Private or Governmental Non-Profit Public Service Group involved at any training, event or incident that I have photographed &/or videoed.
  • Anyone directly involved in the event from or associated with any above Group. (including involved informal &/or coincidental authorized helpers)

 

Authorized uses -

Groups* - 

  • May post selected photo(s) from this website to any non-commercial personal &/or Group digital media (e.g. websites, social media, blogs, zines, etc.) for general informational or Editorial uses.
  • May use in digital &/or print in any local (e.g. in-house) training programs.
  • May make limited print copies and merchandise (e.g.- framed prints, awards, plaques, personal kitsch, coffee mugs, etc.) for awards, mementos and for Non-Commercial Personal Use.

Involved Individuals* - 

  • May post selected photo(s) from this website to any non-commercial personal &/or Group digital media (e.g. websites, social media, blogs, zines, etc.) for general informational or Editorial uses.
  • May obtain digital download from their own agency PIO or from photographer to make limited print copies or merchandise (e.g.- framed prints, awards, plaques, personal kitsch,coffee mugs, etc.) for Non-Commercial Personal Use to commemorate their involvement.

 

Unauthorized uses - 

No Person/Party or Group may -

  • Sub-license, Sell, Trade, Barter, Monetize, or Fundraise from any of these photos/videos without photographers specific written permission.
  • Commercially distribute or release photographs to any other third party without photographers specific written permission.
  • Commercial Uses (recruitment, fundraising and/or sales) are not allowed by this license  -
    • (Commercial and other uses, such as recruitment, fundraising and/or sales of photos where profits go to the Group, will be considered and most likely granted. However to protect both parties these situations require an separate license agreement to ensure compliance with all issues. Contact Photographer directly with request.)
  • Store, scan, submit or use in or through any AI applications.
  • Remove any watermarks &/or copyright marks (Federal crime with $2,500 fine 17 U.S. Code § 506)
  • Alter Photos/videos in any way without the prior written permission of Photographer.
  • Use photos/videos in any trademark, design, logo or other mark.
  • Use photos/videos in any way that allows a standalone file or content file to be downloaded, extracted, or redistributed by others
  • Use photos/videos in any unlawful manner, such as pornography or defamation.

 

Ownership of Photos

Group/Involved Individuals agrees that, subject to the rights and licenses granted herein, Photographer is, and will remain, the sole and exclusive owner of all right, title, and interest, throughout the world, to all Photos and any copies of the Photos. Except as expressly provided in this Agreement, Photographer reserves all rights and licenses not expressly granted in this Agreement.

Group/Involved Individuals must include a photo credit or copyright notice in the name of the Photographer on all Photos.

 

Definitions

 * Group -

  • Any Police, Fire, EMS, SAR, Military, or other Emergency Service organization involved in event.
  • Any other person/party or group requested on-site or in an off-site support role by any of the above agencies.
  • Any Organizational officer of these agencies involved whether on-site or not.

 

 * Involved Individuals -

  • Anyone from an involved Group that was directly involved with in the event including off-site support role(s).
  • Any other person/party or group requested on-site or in an off-site support role by any of the above agencies.
  • This specifically includes any involved informal &/or coincidental authorized helpers. (Per Diem volunteers or helpers e.g. family, friends, etc.)

 

Photo

Interchangeably means Still and/or Video images 

 

Personal use -

  • Non-monetized uses only and of a limited use and specific distribution. Typically self and family. (reportage on personal websites, social media sites IS specifically allowed)
  • No mass distribution (e.g. - advertising or marketing materials, books, magazines, TV, movies, video games, etc.)
  • No sale of photos or items with photos on it.

 

Commercial use -

This is well defined and clear cut but sometimes complex. Most important concepts to be careful of are

  • ANY mass public distribution (e.g. - advertising or marketing materials, books, magazines, TV, movies, video games, etc.)
  • ANY monetized use by anyone other than photographer without a commercial license from photographer.
  • ANY fundraising, recruiting or promotional use.  (a separate commercial use license is required)
